Golf Cart Acknowledgement
By signing this form, I hereby acknowledge that operation of a golf cart on property carries with it the potential for death, serious personal injury and/or property loss. The risks include, but are not limited to, those caused by terrain, temperature, weather, equipment, vehicular traffic, actions of other people, including but not limited to, other operators of golf carts and off-road vehicles. I hereby assume all of the risks of the operation of the golf cart and agree to follow all posted and supplied rules related to its operation and use. Further, I realize that liability may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment, or property owned, maintained or controlled by them or others, or because of their possible liability without fault attributed to me.
I certify that I am physically able to operate the golf cart and have not been advised otherwise by any qualified medical person.
I certify that no person under the age of 21 will operate the golf cart and that keys will be taken from the golf cart and placed in the appropriate location in the unit after each use.
In consideration of my use of the golf cart on property in accord with my unit rental, I hereby take action for myself, all members of my vacation rental party (as the primary name on the reservation), my executors, administrators, heirs, personal representatives, next of kin, successors and assigns as follows: (a) waive, release and forever discharge from any and all liability for death, disability, personal injury, property damage, property theft or actions of any kind which may hereafter accrue to me, THE FOLLOWING ENTITIES OR PERSONS: Rent Branson, Amazing Branson Rentals, and all their agents, representatives, directors, officers, employees, contractors, event holders and sponsors, and all others who may be affiliated with them; (b) Indemnify and hold harmless the entities or persons mentioned in this paragraph from any and all liabilities, costs, damages, or claims made as a result of my use of the golf cart and the real property whether caused by the negligence of those released or otherwise.
This Accident Waiver and Releases of Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
I hereby certify that I have read this release, understand its contents, and freely and voluntarily agree to these terms.
PARENT AND GUARDIAN WAIVER FOR MINORS (UNDER 18 YEARS OLD) REQUIRED
The undersigned parent and natural guardian (if applicable) does hereby represent that he/she is in fact acting in such legal capacity and agrees to release, indemnify and hold harmless each and all of the parties referred to above and as set forth on the terms expressed herein on behalf of the minor passengers so identified.
**** Primary reservation holders whose names appear on the reservation will be responsible for all drivers/riders during their stay.
